TDS return filing: quick answer

TDS return filing is the quarterly statement that a person who deducts tax at source submits to the Income Tax Department, reporting the amounts paid, tax deducted, deductee PANs and the challans used to deposit the tax.

What is TDS return filing?

Tax Deducted at Source (TDS) requires certain payers to deduct tax when paying salary, contractor and professional fees, rent, interest, commission and similar amounts, and to deposit it with the government. The TDS return is the statement that reports who was paid, how much tax was deducted and when it was deposited.

The return is what makes the deducted tax appear in the deductee's Form 26AS and Annual Information Statement. If it is filed late, filed with wrong PANs or does not match the challans, the deductee may not get credit, and the deductor may face a late fee, interest or a notice.

Every deductor needs a Tax Deduction and Collection Account Number (TAN). For official information, returns, certificates and defaults, visit the Income Tax e-filing portal (incometax.gov.in) and TRACES (tdscpc.gov.in).

What is TDS return filing?

TDS return filing is the quarterly submission of a statement to the Income Tax Department by a person who deducts tax at source. It reports the deductee details, amounts paid, tax deducted and the challans used to deposit that tax, so that credit can appear in the deductee's Form 26AS and AIS.

Who needs to file a TDS return?

Any person who deducts TDS, such as an employer paying salary, a company or firm paying contractors, professionals, rent or interest, or a payer of amounts to non-residents, needs a TAN and must file TDS returns. Collectors of tax at source file TCS returns. Some individuals and HUFs have separate rules.

Which TDS return form should I file?

Form 24Q is for TDS on salary. Form 26Q is for TDS on payments other than salary to residents. Form 27Q is for payments to non-residents, and Form 27EQ is for tax collected at source. Special challan-cum-statement forms apply to certain transactions such as property purchase and rent by individuals.

What are the due dates for TDS returns?

TDS returns are filed quarterly. Generally the dates are 31 July for April to June, 31 October for July to September, 31 January for October to December, and 31 May for January to March. The government can change dates, so we confirm them before filing.

What documents are needed to file a TDS return?

You need your TAN and PAN, TRACES and e-filing login details, challan details such as BSR code, date and serial number, deductee names and PANs, payment and deduction details, and for salary returns, employee salary and declaration data. Corrections also need the earlier statement's token number.

What is the penalty for late filing of a TDS return?

A late filing fee of 200 rupees per day applies until the return is filed, capped at the total TDS amount for that statement. A penalty can also be imposed for continued delay or incorrect information, and interest applies on late deduction or late deposit. We confirm the current rules for your case.

How is a TDS return filed online?

The statement is prepared in the prescribed format and validated with the File Validation Utility, which creates an FVU file. It is then uploaded on the income tax portal or through a TIN facilitation channel using a digital signature or electronic verification code, after which an acknowledgement and token number are issued.

Can a TDS return be corrected after filing?

Yes. You can file a correction statement to fix errors such as wrong PAN, challan details or amounts. Corrections are filed against the original statement, and we use the TRACES justification report to find what needs to be fixed.

What are Form 16 and Form 16A?

Form 16 is the TDS certificate for salary, and Form 16A is the TDS certificate for non-salary payments. Both are generated from TRACES after the related TDS return is filed and processed, and they help the deductee claim credit for the tax deducted.
