Patent registration in Dwarka
Quick answer: Patent registration in Dwarka protects a new, inventive and industrially useful invention for 20 years under the Patents Act, 1970. Applications are filed online; the government fee is ₹1,600 for individuals, startups and small entities and ₹8,000 for others, plus ₹4,000 or ₹20,000 to request examination. File before you disclose the invention publicly.
From hardware and electronics startups to product makers, researchers and software teams in Dwarka, we protect what you invented, not just what it looks like: patentability search, drafting, provisional and complete filing, examination reply, hearing and renewal. The basics
What patent registration in Dwarka actually protects
A patent gives the inventor the exclusive right to prevent others from making, using, offering for sale, selling or importing the invention in India without consent (Section 48, Patents Act, 1970). It protects how something works or is made, not how it looks (design registration) and not its brand name (trademark registration). There is no separate "Dwarka patent": a Dwarka inventor files online like any applicant in India (see our national patent registration guide), and what a local consultant adds is a correct patentability check, strong claims and careful timing before the filing date fixes your rights.
What does a patent give you?
A monopoly of up to 20 years from the filing date across India, which you can use, license, assign or sell. Licensing and revenue-sharing are usually documented in a joint venture or MOU agreement. In exchange, the invention is published for the public to read.
Who can apply?
The true and first inventor, or their assignee. Individuals, startups, companies, LLPs, research bodies and educational institutions can all apply. DPIIT-recognised startups, Udyam-registered small entities and educational institutions pay reduced fees by filing Form 28.
The rule that decides everything: novelty
If you publish, sell, demonstrate or pitch the invention publicly before filing, you may lose the right to a patent. File first, then launch. If you must share details with a manufacturer or investor, use an NDA.
The exact authority
Which Patent Office handles applications from Dwarka?
Most local pages stay vague here. This is the precise position.
The Delhi Patent Office is in Dwarka
Patents are granted by the Indian Patent Office under the Controller General of Patents, Designs and Trade Marks. The Delhi office is the Intellectual Property Office, Bouddhik Sampada Bhawan, Plot No. 32, Sector 14, Dwarka, New Delhi – 110075, in the same locality as our office. It covers Delhi, Haryana, Himachal Pradesh, Jammu and Kashmir, Punjab, Rajasthan, Uttar Pradesh, Uttarakhand and Chandigarh. Under Rule 4 of the Patents Rules, 2003, the office is decided by the applicant's residence or place of business, or where the invention originated. Filing is electronic through the IP India portal, so the fee and timeline do not change with your location.
Enforcement: Delhi High Court
The Patent Office grants the patent; infringement suits are decided by courts. In Delhi, patent disputes are heard by the Delhi High Court's Intellectual Property Division, and suits cannot be filed below the District Court level (Section 104). If someone copies your invention, our IP dispute team can advise on the next step.
Before you file
What can and cannot be patented in India
Novel: not published, used or known anywhere in the world before the filing date. An Indian patent search shows what already exists.
Inventive step: not obvious to a person skilled in the field, shown by a technical advance or economic significance.
Industrial application: capable of being made or used in industry.
Excluded by Section 3: mere discoveries, mathematical or business methods, computer programs per se (Section 3(k)), new forms of known substances without enhanced efficacy (Section 3(d)), methods of agriculture and treatment of humans or animals, inventions contrary to public order or morality (Section 3(b)), and others.
Not patentable at all: inventions relating to atomic energy (Section 4). Software with a genuine technical effect can still be examined, so ask before you assume it is excluded. Source code itself is protected through copyright registration.

Built for Dwarka's inventors
Patents by Dwarka business type
Electronics, IoT & hardware startups
Circuit arrangements, sensors, chargers and device mechanisms with a technical advance, often paired with a design registration for the casing. Many electronics also need BIS certification, including BIS for power banks.
Software & AI teams
Computer-implemented inventions with a technical effect, such as improved signal processing or device control, drafted carefully around Section 3(k). Code and documentation sit under copyright.
Product makers & small manufacturers
New mechanisms, tools, kitchenware, packaging machinery and process improvements. Pair the patent with MSME registration and, for buyers who ask for it, ISO 9001.
Healthcare & wellness devices
Medical and diagnostic devices; note that methods of treatment are excluded but devices are not. Related approvals include CDSCO registration and ISO 13485.
Students, researchers & academics
Educational institutions pay the reduced fee, and we coordinate ownership between inventor and institution.

Patents Rules, 2003 (as amended 2024)
Government patent fee in India (e-filing)
| Stage | Natural person / startup / small entity | Others (large entity) |
|---|---|---|
| Application, Form 1 (up to 30 pages, 10 claims) | ₹1,600 | ₹8,000 |
| Request for examination, Form 18 | ₹4,000 | ₹20,000 |
| Pre-grant opposition filed by a third party | ₹4,000 | ₹20,000 |
Extra pages and claims attract additional fees, and annual renewal fees apply from the third year. A joint filing by an individual and a company is charged at the higher rate, and wrongly claiming reduced fees can invalidate the filing, so we verify your category first (get Startup India recognition or MSME registration to qualify). Fees can change; we confirm the current schedule before filing.
Timelines
How long does patent registration take?
Filing takes days, but grant takes much longer. Publication happens at 18 months, and the ordinary route to grant commonly takes several years depending on examination backlog, objections and hearings. This is an estimate, not a guarantee. Startups and small entities can ask for expedited examination on Form 18A.
Search & drafting
Patentability check and specification drafted, then filed.
Publication
Published from priority or filing date, or earlier on request.
Request examination
Form 18 must be filed within 31 months.
Reply & hearing
Reply to the examination report, typically within 6 months, extendable on request.
Grant
Patent granted and published in the journal.
Don't confuse them
Patent vs design vs trademark vs copyright
| Patent | Design | Trademark | Copyright | |
|---|---|---|---|---|
| Protects | How an invention works | How a product looks | Brand name, logo | Original works |
| Law | Patents Act, 1970 | Designs Act, 2000 | Trade Marks Act, 1999 | Copyright Act, 1957 |
| Term | 20 years | 10 + 5 years | 10 years, renewable | Generally author's life + 60 years |
One product often needs several: the mechanism under a patent, the shape under design registration, the name under trademark registration (check it with a trademark search), and its artwork or code under copyright. Selling abroad? See international trademark registration.

Common mistakes Dwarka inventors make
Demonstrating, selling or posting the invention before filing, or sharing details without an NDA, which can destroy novelty.
Skipping the patentability search and discovering prior art only after the examination report.
Writing narrow or vague claims, which decide the real scope of protection.
Not settling who owns the invention between co-founders or with employees. A founders agreement and a non-compete agreement settle this early.
Filing abroad without the Section 39 permission or waiting period for inventions made in India.
Missing the 12-month deadline after a provisional filing or the 31-month deadline for Form 18.
Forgetting annual renewal fees, after which the patent can lapse.
Your rights
What a granted patent lets you do
A granted patent lets you stop others from making, using, selling or importing the invention without consent, and to license or assign it for royalties. If someone infringes, a court can grant an injunction and award damages or an account of profits (Section 108). Others can challenge a patent through pre-grant opposition (Section 25(1), after publication and before grant) or post-grant opposition (within 12 months of grant publication), and through revocation, which is why strong claims matter. If your invention is already being copied, our IP dispute team can advise, and a legal notice is often the first step.
