What is a trademark search in India?

A trademark is a name, logo, slogan or other sign that identifies the source of goods or services. Before an application is accepted, the Registry compares it with earlier marks. A mark can be refused if it is identical or similar to an earlier mark and used for identical or similar goods or services, if it is not distinctive, or if it is merely descriptive of what is sold.

A trademark search lets you run that comparison yourself before the Registry does. It covers the exact name and also variations: different spellings, similar sound, translations, added words and, for logos, similar visual elements. Because trademarks are filed by class, the search also looks at the class you plan to use and the classes closely related to it.

The Registry is not the only place to look. A business that has been using a name for years may have rights even without registration, and can object to a later mark. A complete search therefore adds a check of the market, domain names, social media handles and online marketplaces to the Registry search.
